Terms of Service
Terms of the Direct Website service. Version 2026-10-22.
Initial setup
The initial setup costs €99 (launch price; reference price €199), final price, one-off payment. It covers the setup of the owner's website and booking channel; it is not the purchase of the website or its code.
Plans
Pay-per-booking plan: not offered to new contracts; existing contracts on it, if any, keep their terms, which are as follows. €0/month plus 7% of each booking amount (final price). It includes normal Stripe processing, which OwnGuests bears. It applies to bookings of €125 or more: the €125 minimum applies only to this plan and not to the fixed-fee plans. Its availability depends on location: it is currently not available for properties located in the Canary Islands or for owners with a tax address in the Canary Islands, and in Ceuta and Melilla only when the owner and the property are in the same city.
No-OwnGuests-commission plan: €24/month or €240/year (final price), 0% OwnGuests commission on bookings. Bookings are processed through the owner's own Stripe account. OwnGuests does not receive the amount of those bookings or charge a commission on them. The owner contracts directly with Stripe: booking money goes to their account and Stripe deducts its processing fees (they depend on the card type; from 1.5% + €0.25 with standard EEA cards), as well as the amounts and costs of refunds and disputes of those transactions. OwnGuests provides the technical integration and charges the fee. To do so, the owner creates their Stripe account with their own email, privately completes identity verification, the bank account, acceptance of Stripe's terms and their two-step authentication, and gives OwnGuests a restricted technical key (never passwords or codes), which they can revoke at any time. There is no minimum booking on these plans. The fee is charged in advance, by card or SEPA Direct Debit, through Stripe, on the day of purchase and renews automatically on that same day every month (monthly) or every year (annual), for the full period and with no proration. The processing cost of charging the fee itself is borne by OwnGuests.
The Direct Website is only published and served while the service is active (with a current plan and, on fixed-fee plans, the fee up to date within the retries and the owner's own Stripe account ready to take payments). If the service is suspended or ends, the website stops being visible to guests; the owner keeps their account and, during the operational access period, their panel to handle bookings already confirmed, refunds and disputes. Plan changes: from the per-booking plan to a fixed-fee plan, the switch applies when the first fee is paid, with the owner's own Stripe account already ready; switching from a fixed-fee plan to the per-booking plan is not available while that plan is not offered to new contracts. Until then the previous plan continues. There is never proration, and the 7% commission and a fee never apply at the same time.
Property location and local obligations
Except for the international sale described below, OwnGuests can currently be contracted by holders with a tax address in Spain. The property may be in Spain or, for the initial setup and the fixed-fee plans only, in one of these euro-area countries: Portugal, France, Italy, Germany, the Netherlands, Belgium, Austria, Ireland, Greece, Luxembourg, Finland, Estonia, Latvia, Lithuania, Slovakia, Slovenia, Malta, Cyprus and Croatia. The holder declares the property's country before paying; if no plan is available for that combination, OwnGuests does not charge the initial setup.
The holder is solely responsible for meeting the obligations that apply to their property where it is located: short-term or holiday rental licences or registrations, registration numbers that must be shown in listings, recording and reporting guest data to the authorities, tourist taxes or levies, taxes on their income and any other applicable rules. OwnGuests shows on the website the details the holder provides (for example, their registration number), but does not check them or handle those procedures, and does not guarantee that the website or the service on their own comply with the rules of any country.
CheckInSecure, a separate free product, is only for guest registration in Spain; for properties outside Spain it does not replace each country's guest reporting systems.
Lock-in, annual prepayment and withdrawal
The per-booking plan and the monthly plan have no lock-in: they can be cancelled at any time, effective at the end of the already-paid period, if any.
The annual plan is a 12-month prepayment which, once purchased, is non-refundable in exchange for the discount on the monthly fee, without prejudice to any rights the law grants the owner that cannot be waived -- in particular, the 14 calendar-day withdrawal right that consumer regulations grant to whoever contracts as a consumer rather than as a professional, exercised by writing to privacy@checkinsecure.com.
Fixed-fee plans renew automatically at the end of each period. The owner can cancel the renewal at any time from their account, effective at the end of the period already paid. If a renewal charge fails, it is retried up to three times in total; meanwhile the service continues, and if the third attempt fails the service is suspended (the website is no longer visible and accepts no new bookings) until it is paid, without affecting bookings already confirmed. As soon as the payment goes through, the service is reactivated automatically.
Launch offer (founder plan)
The launch offer (founder plan) only exists while OwnGuests announces it on its website, and an order includes it only if the setup payment page says so next to the pay button (“Includes the launch offer”). While it is in force, the first 30 Direct Websites purchased (setups paid and not refunded) pay the €99 initial setup and include the first calendar month of the €24 monthly plan, counted from the day the website is published (never during the build). The offer is assigned when the setup payment is started, if places remain at that moment, and it is honoured even if someone else completes the payment for the last place at the same time. It only applies if the monthly plan is chosen; the annual plan keeps its normal price and terms, with no included month.
Before the website is published, the owner expressly authorises the future charge to their card or by SEPA Direct Debit, on a secure Stripe page; nothing is charged that day. When the included month ends, €24 is charged and then €24 every month, on the same day, until the owner cancels. OwnGuests sends an email reminder 7 days before the first charge. Cancelling before that date has no cost: nothing is charged and the service ends at the end of the included month. Once monthly billing has started, cancellation takes effect at the end of the month already paid: no further month is charged, but the current month, already charged, is not refunded. During the included month the plan can't be changed self-service (it's handled with OwnGuests). The included period is not refunded or exchanged for money.
14-day guarantee
If the Direct Website doesn't convince you, OwnGuests refunds the full €99 setup fee when requested in writing (contact form or privacy@checkinsecure.com) within 14 calendar days of its publication, without having to give a reason; before it is published, the refund can be requested at any time. The refund is made to the same payment method within 14 days at most. OwnGuests bears the processing cost of that refund.
The refund means the service ends that same day: the website stops being shown and accepting new bookings, and the owner keeps access to their panel to look after bookings already confirmed, their charges, refunds and disputes, during the usual operational access period. If there is a launch offer subscription, it is cancelled with no charge. The domain always belongs to the owner: OwnGuests doesn't charge for it, doesn't refund it and never withholds it. Commissions on bookings already charged correspond to a service provided and are not refunded. This guarantee does not limit the legal right of withdrawal of anyone who purchases as a consumer.
International sale (holders outside Spain)
Holders with a billing address outside Spain, in the countries the order page offers for the international sale, contract under the terms of this section, which prevail for them over “Initial setup”, “Plans”, “Launch offer” and “14-day guarantee”. Each payment is processed and invoiced by Link, Stripe's payment service, which acts as seller (merchant of record) of that payment, issues the receipt and invoice and applies the corresponding taxes; Link's terms shown at payment also apply to that payment. OwnGuests does not issue its own invoice for these payments.
Initial access: €99, one-off payment, final price. It gives access to the OwnGuests software to generate the website from the owner's details, review it in a preview, approve it and publish it themselves. It is an automated service: it does not include design, texts or review done by a person; it does include written support. This payment creates no subscription and authorises no future charge. It is not the purchase of the website or its code.
Plan: it is taken out in a second, separate payment when the owner publishes their website, and never before. Monthly: €24/month; the first month from publication is included and, when it ends, €24 is charged every month until the owner cancels. Annual: €240 for 12 months, charged in that second payment; it is a non-refundable prepayment, except for any rights the law grants the owner that cannot be excluded. Both renew automatically and can be cancelled at any time from the account, effective at the end of the period already paid (on the monthly plan, at the end of the included month if no fee has been charged yet). While the plan is not active, the published website is not shown. Bookings are charged to the owner's own Stripe account, as described under “Plans” for the no-OwnGuests-commission plan.
Guarantee: before publication, or within 14 calendar days after publication, the owner can ask from their account for a refund of the €99 initial payment, without giving a reason. The guarantee only covers that initial payment, never plan fees, and means the service is cancelled. Before publication, or during the monthly plan's included month (with no fee charged), the plan is cancelled with no charge and the service ends that day. With the annual plan already paid, the €240 is not refunded, the plan does not renew and the website keeps working until the end of the paid year. After cancellation, the owner keeps access to their panel to look after bookings already confirmed, their charges, refunds and disputes during the usual operational access period. The refund is made to the same payment method. This guarantee does not limit the owner's statutory rights, in particular the withdrawal right of anyone who contracts as a consumer.
Website language: the owner chooses the language (Spanish or English) of their website's system texts (booking, payment, notices and emails to guests). Their own content is published as they write it, without translation. The property's local obligations described under “Property location and local obligations” also rest with the holder.
Domain
The domain belongs to the owner, who pays its yearly renewal separately, at cost and with no markup. If the owner leaves OwnGuests, they can take their domain with them.
Payments with Stripe
The guest pays each booking to the owner, who provides the accommodation. Per-booking plan: the payment is processed through Stripe Connect on behalf of the owner: the owner's Stripe account appears as the merchant of the payment, which is what the guest sees on the payment page and on their card statement (so the owner must set a recognisable business name, for example their property's name, when signing up with Stripe). OwnGuests orchestrates the payment with its technology: the amount settles in OwnGuests' Stripe balance only to be split at that same moment, automatically: the owner receives the booking amount minus the 7% commission and OwnGuests receives its commission. OwnGuests does not have the owner's money at its disposal beyond that split. Fixed-fee plans: the payment is processed in the owner's own Stripe account and the money does not go through OwnGuests. In both cases Stripe handles identity verification (KYC), the bank account and payouts to the owner according to its payout schedule; OwnGuests never stores the owner's IBAN. The invoice or document for the stay, where legally required, is issued by the owner to the guest; OwnGuests invoices the owner for its commission or its fee.
Cancellations, refunds and commission
Each booking is governed by the rental's cancellation policy in force at the time of booking. Refunds, when applicable, are issued by the owner from their panel.
On the pay-per-booking plan, the 7% commission is calculated on the amount the owner keeps after applying that policy. When a booking is refunded, Stripe does not return its processing fees (Stripe's public rate: 1.5% + €0.25 for standard European cards, more for premium, UK or international cards); OwnGuests may retain from its commission an amount equal to those unrecoverable costs, which are borne by the owner, so that a cancellation does not result in a loss for OwnGuests. Example: a €200 booking, €14 commission; if refunded in full and the unrecovered processing cost is €3.25, OwnGuests could retain €3.25 of that commission and refund the rest. Today this retention is not applied: OwnGuests refunds its commission in proportion to the amount refunded and bears that cost; if it were to start applying it, the owner would be notified in advance.
OwnGuests invoices
OwnGuests invoices the owner for the initial setup, the fixed-plan fees actually collected and, on the per-booking plan, the commission on each paid booking, using the billing details the owner keeps in their account (name or company name, tax ID and address). Without complete details no invoice is issued: it remains pending until the owner completes them. OwnGuests prices are final prices: the invoice reflects the tax treatment that applies according to the customer's territory and declared status -- VAT included in mainland Spain and the Balearic Islands; for businesses or professionals established in the Canary Islands, Ceuta or Melilla, without Spanish VAT and under the reverse charge (the customer self-assesses IGIC or IPSI). Invoices show the taxable base, the tax rate and the tax amount separately, or the applicable legal statement when no VAT is charged. When the setup, a fee or a booking commission is refunded in whole or in part, OwnGuests issues the corresponding corrective invoice; an issued invoice is never modified or deleted. Invoices are issued in Spanish.
By signing up, the owner agrees to receive invoices electronically: they are available in their OwnGuests account (with an email notice) and can be downloaded as PDF at any time. If the owner prefers paper invoices, they can request them at privacy@checkinsecure.com.
Automatic payment-gateway receipts are not invoices. The invoice for the stay, where legally required, is issued to the guest by the owner, who provides the accommodation.
Disputes and chargebacks
Per-booking plan: the 7% includes normal Stripe processing, not extraordinary costs. Any fees Stripe charges for disputes or chargebacks associated with a booking (Stripe's public rate: €20 per dispute), and the disputed amount, are the owner's responsibility. OwnGuests detects, logs and flags disputes; recovery from the owner is manual until an automatic collection mechanism exists (see Risks). Fixed-fee plans: disputes happen in the owner's own Stripe account, which the owner handles and bears (amount, fee and outcome); OwnGuests only reports them.
Operational risks the owner accepts
Calendar sync (iCal): reduces the risk of a double booking across channels but does not eliminate it -- Airbnb syncs at most every 3 hours and Booking every 2 hours. OwnGuests detects and flags conflicts that arise; it does not guarantee zero overlaps.
A refund that Stripe marks as completed can later fail (for example, a cancelled card); in that case OwnGuests notifies both parties and handles the compensation manually.
Termination and portability
The owner may leave the service at any time and take their domain with them. Purchasing their Direct Website's code as a standalone deployment is optional, at a final one-off price confirmed in writing on request; it does not include ongoing maintenance. Once that exit is paid and delivered, OwnGuests stops serving the website. The technical terms of delivery (deployment to the owner's own account, data and content included) are confirmed in writing when requested.
Liability, availability, governing law and jurisdiction
OwnGuests strives to keep the service available but cannot guarantee 100% availability. We do not control Stripe, Resend, Cloudflare or external platforms (Airbnb, Booking, Vrbo), and we do not guarantee their availability or the accuracy of the data they synchronize.
Nothing in these terms excludes or limits our liability where the law does not allow it to be excluded or limited (our own wilful misconduct or gross negligence, death or personal injury caused by negligence, and the mandatory data-protection obligations that apply to us). Outside those cases, our economic liability to the owner is limited to the amounts actually paid by the owner to OwnGuests (setup, commissions and fees) in the 12 months preceding the event giving rise to the claim.
These Terms are governed by Spanish law. For any dispute, the parties submit to the courts corresponding to the operator's registered address as identified in the Legal notice, without prejudice to any mandatory consumer-protection venue rules that may apply to owners who qualify as consumers.
